Completing the Return Policy
Following the purchase of the Products marketed by the Company, through the Website, a Distance Contract is concluded between you and the Company. The content of this Distance Contract is provided by the Terms and Conditions - CRIDA PHARM S.R.L. together with the legal provisions that apply in addition to the GDPR Policies and this Return Policy.
The return policy further provides the conditions under which you can benefit from the right to return the Products, and the amounts paid at the time of purchase will be refunded to you.
Chapter II – The right to withdraw from the contract (the right to return the Products) granted to the Consumers
In accordance with the legal provisions, if you are a Consumer, you have a right of withdrawal from the concluded Distance Contract, without having to justify your decision in any way. In other words, you have the possibility to return the Products purchased following the conclusion of the Distance Contract, under the conditions described below, without having to justify your decision, with the Company returning the sums of money paid as price. The legal provisions contained in art. 9 para. 1 of O.U.G. no. 34/2014 provide the following: "Except for the cases provided for in art. 16, the consumer benefits from a period of 14 days to withdraw from a contract at a distance or from a contract outside the commercial premises, without having to justify the decision to withdraw and without incurring other costs than those provided for in art. . 13 para. (3) and to art. 14”.
The right of return is not granted to Economic Agents.
The withdrawal period in which you can opt to return the Products expires within 14 days of:
The day on which You or the person indicated by You enters/enters physical possession of the Products;
If you place a single order with respect to several Products, and they are delivered separately or in several batches, from the day on which You or the person indicated by You enters/takes physical possession of the last Product or batch of Products.
To return the Products, it is necessary to complete the return form available on the Website, which you can send to the address office@cridapharm.ro, before the expiration of the 14-day period provided for above.
After submitting the withdrawal option, you will receive an email confirming the request made. The product you wish to return must be sent to the following address: Strada Stadionului no. 1, Oltenita, Calarasi county, 915400, ROMANIA.
You must bear in mind that you will bear the cost of shipping for returning the Product.
For the valid exercise of the right of return, it is necessary to communicate the return form to us before the expiration of the 14-day period. In accordance with the legal provisions and depending on your preferences, you can also use the form provided in Part B of the Annex to the Government Emergency Ordinance no. 34/2014 regarding the rights of consumers in contracts concluded with professionals, as well as for the modification and completion of some normative acts, with subsequent amendments.
After communicating your option, for the purpose of exercising the right of withdrawal (return), the Distance Contract will no longer be executed, the obligations provided for in it being extinguished.
At the same time, after exercising the right of withdrawal (return), it is necessary to return the Products to us within no more than 14 days from the date on which you notified us of your decision to withdraw from the Distance Contract.
If you have paid the price of the Products (including shipping costs), you declare and expressly agree that this price collected will be returned to you by bank transfer, to the account indicated in the form provided for the return. The amounts in question will be refunded to you within a maximum of 14 days from the communication of the withdrawal, subject to the return of the Products by the expiry of this period. It is possible that the time period for the return of the amounts will be extended, if the Products reach Us towards the end of the mentioned period of 14 days. However, if you do not have a bank account, please contact us at the contact details provided to arrange a means of refunding the amounts in question.
Prior to the return of the sums of money paid as Price, the Company reserves the right to carry out checks on the date of return of the Products by the courier company, so that they do not present damage, unauthorized uses or non-conformities. To the extent that the Product shows some non-conformities or unauthorized uses, the value of the price paid by you, to be returned, will be reduced by the amount necessary to repair these non-conformities. In this regard, if it will be the case, we will inform you accordingly. The relevant legal provisions provide: "CONSUMERis only responsible for the diminution of the value of the products resulting from their handling, other than what is necessary to determine the nature, characteristics and operation of the products. The decrease in the value of the products must not be a disincentive for the consumer to exercise his right of withdrawal".
For example, the manipulations accepted to determine the nature, characteristics and functioning of the Products are:
visual, tactile and olfactory inspection of the Products, when the provisions below are not violated;
you only have the right to verify that the Product is suitable for the needs for which it was ordered, not to use it, unseal it and the like.
The following actions that lead to a decrease in the value of the Product are not allowed, as they are also not allowed in stores:
using the Products in any way other than visually inspecting and verifying their conformity;
breaking seals and labels;
breaking or damaging, scratching, soiling, staining, hitting or impregnating the Products with external substances;
Any use or different use of the Products, beyond the limit necessary to establish the nature, characteristics of the Products and which generates damages or non-conformities on them, will attract your obligation to bear the decrease in the value of the Products with these damages or non-conformities.
In this case, the Company will compensate the value of the non-conformities or damages with the amounts that should have been returned to you, only returning the related difference.
Chapter III– Absence/Termination/Loss of the right of withdrawal from the Distance Contract (the right of return)
In accordance with the legal provisions, you do not benefit from the right of withdrawal from the Distance Contract (the right of return to the Products) in the cases provided for by art. 16 of the O.U.G. no. 34/2014, especially in the following situations:
If you purchase Products likely to deteriorate or expire quickly;
If you have purchased sealed Products, and they have been unsealed by you and thus can no longer be returned for health protection or hygiene reasons;
If one of the purchased Products falls into the category mentioned above, then you can no longer return the Product in question.
Thus, you understand and accept that to the extent that the ordered Product has a short shelf life or is susceptible to rapid deterioration, you will not be able to return the ordered Product, this situation being exempt from the granting of the right of return, according to the legal provisions.
Also, to the extent that you have ordered a sealed Product, you expressly understand and accept that it can no longer be returned in the situation where the Product has been unsealed, and the measure is required for reasons of health protection or for reasons of hygiene (such as in the case of unsealed personal care products).

To the extent that you need other information regarding the Return Policy or if you encounter difficulties in returning the Products, please write to us at the indicated contact details or to the address: office@cridapharm.ro.
The Company reserves the right to modify the Return Policy as it deems necessary. To the extent that, after making these changes, you do not agree with the new content, please stop using the Website or the Company Products.
